Aim of the course
The course analyses the essential aspects of the Italian constitutional framework in order to enable students to understand the relationships between the powers of the state and the characteristics of the regional legal systems. Some of the lessons will deal with the development of the Italian welfare state and its recent constitutional reforms.
Syllabus
·        Legal system and regulations. The State and its constituent elements.
·        Forms of government and state. Italian constitutional events and overview of constitutional history.
·        Sources of law. Criteria for resolution of regulatory antinomies. The State and the international legal system. Sources of community law:
·        Electoral systems and political rights. Institutions of direct democracy: referendums.
·        Parliament: structure and organisation.
·        Functions of Parliament. The law.
·        Government: structure and functions.
·        Legislative decree and Emergency decree. Regulations.
·        The President of the Republic: functions and responsibilities.
·        Public administration and auxiliary bodies.
·        The administrative arm; administrative acts; safeguards against unlawful actions of the P.A. The judiciary.
·        Local autonomies under the constitution: regions and infra-regional bodies.
·        Constitutional guarantees. Amendment of the constitution. The constitutional court.
·        Rights and duties of citizens.
·        The economy in the constitution.
·        Public administration of the economy. From dirigiste State to regulatory State.
·        Independent authorities.

Examinations
There will be an oral examination at the end of the course.
